Most employers (especially in New York City) know that it is almost impossible for any worker (especially any non-White worker) to successfully contest an employer's right to decide the worker's qualifications. In fact, I would be surpised if there is any judge in New York City who has ever found a non-White qualified for anything.

This bring us to Simpson Thacher and its silly ass Word Processing Test.

It has been clear to a lot of us for a long time that who Simpson Thacher claimed passed their WP Test had more to do with what kind of temps the Simpson Thacher supervisors liked (and didn't like) rather than on how the testers actually did on the test.

Simpson Thacher is a litigation firm and it clearly knows that it can rely on the Courts to hand it a victory in any lawsuit claiming that Simpson Thacher's testing method was arbitrary, subjective and or a down right fraud. Simpson Thacher was ready and eager to litigate the issue that its test was valid and proper until I informed them that I had emailed a detailed description of their test to every temp agency doing business with them since 2001.

Every temp agency doing business with Simpson Thacher has had a detailed description of what is on Simpson Thacher's test and have been training their people on how to pass the test since at least as far back as the summer of 2001. So,

When every temp agency doing business with Simpson Thacher is training their temps on what they know is on Simpson Thacher's test and it always turns out that only Black and Hispanic Females seem to end up passing the test, it just makes Simpson Thacher a bad joke.

Apparently, it never occurred to Simpson Thacher's rocket science supervisors that everyone has been on to them for at least three years now.
